Loop Marketers

Effective Date: Jan 1st, 2023

Purpose:
The purpose of this Do Not Call (DNC) policy is to ensure that Loop Marketers complies with all applicable federal and state telemarketing laws, including the Telephone Consumer Protection Act (TCPA), Telemarketing Sales Rule (TSR), and National Do Not Call (DNC) Registry. As a pay-per-call marketing network, Loop Marketers does not directly place calls but works with third-party marketing publishers/affiliates to generate leads for its clients. This policy outlines the procedures for ensuring that both Loop Marketers and its affiliates respect consumer preferences and privacy by adhering to Do Not Call regulations.


1. Scope of the Policy

This policy applies to all employees, contractors, and third-party agents of Loop Marketers who are involved in telemarketing, outreach, or any other form of direct phone communication with potential or existing clients.

2. Do Not Call List Compliance

  • National Do Not Call Registry: Loop Marketers will comply with the National Do Not Call Registry, which is managed by the Federal Trade Commission (FTC). Employees must ensure that no phone calls are made to numbers listed on the National Do Not Call Registry unless there is an established business relationship.

  • Internal Do Not Call List: Loop Marketers will maintain an internal Do Not Call list of individuals or entities that have requested not to receive unsolicited phone calls. If a customer or prospect requests not to be called, their information will be added to the internal Do Not Call list immediately, and no further calls will be made to that individual or entity.

3. Procedures for Handling Do Not Call Requests

  • Recording Do Not Call Requests: Any customer or potential customer who asks not to be contacted by phone must have their request documented immediately in the appropriate database or CRM system. This documentation should include the individual’s name, phone number, date and time of the request, and the name of the employee who took the request.

  • Internal List Maintenance: Loop Marketers will ensure that the internal Do Not Call list is updated on a regular basis to reflect all new requests and that employees are consistently reviewing and adhering to the list.

  • Third-Party Vendors: If third-party vendors or subcontractors are involved in telemarketing activities on behalf of Loop Marketers, they must adhere to this policy and the same procedures for handling Do Not Call requests. These vendors will be required to demonstrate compliance during regular audits and reviews. In addition, they are required to sign a compliance agreement before working with Loop.

4. Telemarketing Calls Restrictions

  • No Calls to Do Not Call Registry Numbers: Employees of Loop Marketers must not make telemarketing calls to any phone number listed on the National Do Not Call Registry, unless the individual has provided written consent to receive calls or has an established business relationship with the company.

  • No Calls to Individuals on the Internal List: If a customer or prospect has placed themselves on the Loop Marketers’ internal Do Not Call list, no calls may be made to that individual, regardless of whether the number is on the National Do Not Call Registry.

5. Exemptions

The Do Not Call requirements do not apply to certain types of calls, including but not limited to:

  • Established Business Relationship (EBR): Calls to individuals with whom Loop Marketers has an established business relationship are exempt from Do Not Call restrictions. An EBR exists when a consumer has engaged with Loop Marketers within the past 18 months or has made an inquiry or application for products or services in the past 3 months.

  • Political, Charitable, and Survey Calls: Calls made for political purposes, charitable solicitations, or surveys may be subject to different regulations, though Loop Marketers will strive to adhere to Do Not Call rules whenever applicable.

6. Employee Training

  • Initial and Ongoing Training: All employees involved in telemarketing activities will receive initial and ongoing training on the Do Not Call requirements under this policy, including recognizing and respecting DNC requests.

  • Tracking Compliance: Regular audits will be conducted to ensure that employees are adhering to the Do Not Call policies. Violations will be addressed promptly, and corrective actions will be taken.

7. Penalties for Non-Compliance

Violations of this Do Not Call policy may result in disciplinary actions up to and including termination of employment or contract with Loop Marketers. Employees found violating the policy may also be subject to legal penalties in accordance with applicable federal or state laws.

8. Monitoring and Enforcement

Loop Marketers will implement monitoring systems to ensure compliance with this policy, including regular checks of telemarketing lists, auditing of call records, and reviewing customer complaints. If a violation is discovered, corrective actions will be taken, including the possibility of re-training or disciplinary action.

9. Consumer Complaints

Any consumer who believes they have received an unsolicited call in violation of the Do Not Call policy may file a complaint with Loop Marketers’ Customer Support team. All complaints will be investigated promptly, and corrective action will be taken where necessary.

10. Policy Updates

This Do Not Call policy will be reviewed and updated periodically to ensure ongoing compliance with relevant laws and regulations. Updates will be communicated to all employees and third-party vendors, and training will be provided as needed.
